Terms of Service
Elite Filming

These Terms of Service apply to services provided by Elite Filming, including videography, filming, photography, editing, post-production and related media services.
By accepting a quotation, making a booking, paying a booking fee or instructing Elite Filming to begin work, you agree to these Terms of Service.

References to “we”, “us” and “our” in these terms mean Elite Filming.
References to “you”, “your” or “the client” mean the person, business or organisation purchasing our services.
2. Quotations
Any quotation provided by Elite Filming will describe the services included in the project and the agreed price.
Unless otherwise stated, quotations are valid for 30 days from the date they are issued.
A quotation does not reserve a filming or event date until the required booking fee has been received and we have confirmed the booking.
Additional work that is not included within the original quotation may result in additional charges.
We will inform you of any significant additional costs before carrying out additional work.
3. Booking
A booking is confirmed when:
- The client accepts our quotation or booking agreement;
- Any required booking information has been provided;
- The required booking fee has been paid; and
- Elite Filming confirms the booking.
Until these requirements have been completed, dates remain available to other clients.
4. Booking Fee
Unless otherwise agreed, a 25% booking fee is required to secure a filming date.
The booking fee forms part of the total project price and is deducted from the final balance.
If the client later cancels, any amount retained from the booking fee will be limited to what is reasonable in light of losses and costs arising from the cancellation and any amounts we are reasonably able to recover by accepting replacement work.
Nothing in these terms affects any statutory cancellation or refund rights you may have as a consumer.
5. Payment
Unless otherwise agreed in writing:
- 25% is payable when the booking is confirmed; and
- The remaining balance must be paid no later than 7 days before the filming date.
For commercial or ongoing projects, a different payment schedule may be specified within the quotation or invoice.
Editing, final delivery or release of completed material may be withheld while an invoice is overdue.
Clients are responsible for checking invoices and notifying us promptly if they believe an invoice is incorrect.
6. Consumer Cancellation Rights
If you are acting as a consumer rather than a business, you may have additional cancellation rights under UK consumer law.
Where a statutory 14-day cancellation period applies to a booking made online, by telephone or away from our business premises, you may cancel during that period in accordance with your legal rights.
If you specifically ask Elite Filming to begin providing services during an applicable cancellation period, you may be required to pay for services reasonably provided before you cancel.
If the service has been fully performed after you expressly requested that performance begin during the cancellation period and you acknowledged that your cancellation right would be lost on full performance, your statutory cancellation right may end.
Any statutory rights you have take priority over conflicting provisions within these Terms of Service.
7. Cancellation by the Client
If you need to cancel a confirmed booking, please notify Elite Filming as soon as possible in writing.
Where the cancellation is not made under a statutory cancellation right, we may retain or charge an amount representing losses reasonably resulting from the cancellation.
This may include:
- Work already completed;
- Administration and planning already undertaken;
- Non-refundable expenses incurred specifically for your project;
- Payments committed to crew, venues or suppliers;
- Lost income where we are unable to reasonably replace the cancelled booking.
We will take reasonable steps to reduce our losses, including attempting to accept another booking for the cancelled date where practical.
We will not charge more than our reasonable loss resulting from the cancellation.
8. Rescheduling
We understand that plans sometimes change.
If you ask to move your filming date, we will make reasonable efforts to accommodate the request.
Any change is subject to availability.
Where we are available on the new date, payments already made will normally be transferred to the new booking.
Additional costs may apply where rescheduling results in expenses or supplier charges that cannot reasonably be recovered.
If we are unable to accommodate the new date, the booking may be treated as a cancellation.
9. Cancellation by Elite Filming
Elite Filming may cancel or suspend a booking where there is a genuine reason that prevents us from safely or reasonably completing the work.
This could include:
- Serious illness or injury;
- An emergency;
- Unsafe working conditions;
- Severe weather making filming unsafe or impossible;
- Venue restrictions outside our control;
- Client non-payment;
- Serious breach of these terms; or
- Events outside our reasonable control.
If Elite Filming cancels a booking for reasons that are our responsibility and we cannot provide a suitable replacement or alternative date, payments for services that have not been provided will be refunded.
We will not retain payment for services we have not provided where cancellation is our responsibility.
10. Events Outside Our Control
Elite Filming will not be responsible for failure or delay caused by circumstances outside our reasonable control.
These may include severe weather, fire, flood, transport disruption, venue closure, government restrictions, power failures, equipment being damaged by circumstances beyond our control or other exceptional events.
Where possible, we will work with the client to reschedule the project or find another reasonable solution.
11. Client Responsibilities
The client is responsible for providing Elite Filming with accurate information required to complete the project.
This includes information concerning:
- Filming locations;
- Start and finish times;
- Venue access;
- Parking;
- Important people, activities or moments to be captured;
- Restricted areas;
- Venue rules;
- Security requirements;
- Required permissions; and
- Any significant changes to the agreed schedule.
We cannot guarantee coverage of something that we were not told about or that we were prevented from filming.
12. Venue and Filming Permissions
The client is responsible for ensuring that filming is permitted at the chosen location unless Elite Filming has specifically agreed to arrange permission.
The client should inform venues, property owners, organisers and other relevant parties that professional filming will take place.
Where a licence, permit or access fee is required, the client will be responsible for the cost unless otherwise agreed.
13. People Appearing in Footage
Where Elite Filming has been commissioned to film an event, workplace, private venue or organised activity, the client or event organiser is responsible for arranging appropriate notices, permissions or releases from attendees where these are required.
Elite Filming will cooperate with reasonable requests concerning privacy and individuals who should not be filmed.
14. Filming Style and Creative Decisions
By booking Elite Filming, you acknowledge that photography and filmmaking involve creative judgement.
Our portfolio may be used as an indication of our general filming and editing style, but every project is different.
Elite Filming retains reasonable creative discretion concerning matters including:
- Camera positions;
- Framing;
- Composition;
- Lens selection;
- Lighting;
- Editing;
- Colour grading;
- Audio treatment;
- Music;
- Shot selection; and
- Overall presentation.
Specific requirements that are essential to the project should be agreed before filming begins.
15. Filming Coverage
Although we make every reasonable effort to capture important moments, we cannot guarantee that every person, action, speech or event will be recorded.
Circumstances including guest movement, venue restrictions, lighting conditions, weather, equipment obstruction, schedule changes and instructions from venue staff may affect coverage.
If there are particular shots or moments that are essential, the client should tell us before filming.
16. Delays on the Filming Day
The agreed filming period will begin and end at the times stated within the booking.
Delays caused by the client, venue, guests, performers or other suppliers do not automatically extend the agreed filming period.
Where we are able to remain beyond the agreed time, additional filming may be charged at our applicable overtime rate.
We will tell you about any additional charge where reasonably possible before significant overtime is undertaken.
17. Travel and Expenses
Travel included within the quotation will be stated within the booking.
Additional travel, accommodation, parking, congestion charges, tolls, permits and other reasonable project expenses may be charged separately where these were not included within the original quotation.
Any significant additional expenses will be discussed with the client wherever reasonably possible.
18. Editing and Post-Production
Editing includes the work specifically described within your quotation or package.
Unless otherwise stated, completed videos may include:
- Selection of suitable footage;
- Basic editing;
- Colour correction or grading;
- Audio balancing;
- Titles or graphics agreed within the package; and
- Licensed music selected for the production where applicable.
Complex visual effects, animation, advanced retouching, extensive audio repair, subtitles, additional versions or other work outside the agreed scope may incur an additional charge.
19. Revisions
Unless your quotation states otherwise, Elite Filming includes two reasonable rounds of revisions following delivery of the first completed edit.
Revision requests should be provided clearly and together wherever possible.
Revisions do not include completely changing the originally agreed creative direction or requesting substantial additional work that was not included in the original quotation.
Further revisions or substantial changes may be charged separately.
We will inform you before carrying out chargeable revision work.
20. Delivery Times
Any estimated completion or delivery date is an estimate unless we expressly agree that a particular deadline is guaranteed.
Delivery times depend on the complexity and size of the project.
We will make reasonable efforts to meet agreed deadlines and will notify you if there is likely to be a significant delay.
21. Delivery of Files
Completed work may be delivered using:
- Online download;
- Cloud storage;
- File-transfer services;
- Physical storage media; or
- Another agreed method.
The client is responsible for downloading and securely backing up completed files after delivery.
Online download links may only remain active for a limited period.
22. Raw Footage
Raw or unedited footage is not included unless specifically stated within the quotation.
Raw footage remains part of Elite Filming’s production materials.
If a client requests raw footage, we may agree to provide it subject to an additional fee, storage availability and any applicable third-party rights or restrictions.
23. Project File Storage
Elite Filming does not guarantee permanent storage of raw footage, project files or completed work.
Following final delivery, project materials may be deleted after a reasonable storage period.
Clients should keep their own backup copies of all delivered work.
If long-term archival storage is required, this should be arranged separately in writing.
24. Copyright
Unless otherwise agreed in writing, copyright in footage, photographs, edits and other creative material produced by Elite Filming remains with Elite Filming.
Once the agreed price has been paid in full, the client receives permission to use the completed work for the purposes agreed when the booking was made.
The exact scope of permitted use may vary depending on whether the project is personal, commercial, advertising, broadcast or another type of production.
Copyright ownership can be transferred where specifically agreed in writing and may be subject to an additional fee.
25. Commercial Usage
Commercial clients must tell Elite Filming how the finished material will be used.
This may include:
- Websites;
- Social media;
- Paid advertising;
- Television;
- Cinema;
- Streaming;
- Internal corporate use;
- Events;
- Digital campaigns; or
- Third-party publication.
Additional licensing may be required for uses significantly outside those originally agreed.
26. Elite Filming Portfolio and Promotion
Elite Filming will not automatically publish private or confidential client footage simply because we created it.
Where appropriate, we may ask for permission to display selected completed work on our:
- Website;
- Portfolio;
- Social media;
- Showreels;
- Advertising; or
- Promotional materials.
Where a project is confidential or the client has requested that material is not published, we will respect that agreement.
27. Client-Supplied Material
If you provide Elite Filming with photographs, videos, logos, graphics, music, trademarks or other material, you confirm that you have the necessary permission or rights for us to use that material for your project.
The client will be responsible for claims arising directly from material supplied by the client where Elite Filming had no reasonable reason to know that its use was unauthorised.
28. Music
Commercial music is protected by copyright and cannot automatically be used within a video merely because the client owns or likes the song.
Elite Filming may use properly licensed music appropriate to the project.
If a client requests a particular commercial song, its use will be subject to obtaining the appropriate licence.
Any additional music licensing costs will be discussed with the client.
29. Third-Party Platforms
Elite Filming cannot guarantee how third-party platforms such as YouTube, Instagram, TikTok, Facebook or other services will treat uploaded content.
Platforms may modify compression, image quality, sound quality, dimensions or availability.
Elite Filming is not responsible for platform outages, account restrictions, algorithm changes or content removed by a third-party platform where these matters are outside our control.
30. Equipment Failure and Data Loss
We use reasonable professional procedures and equipment to reduce the risk of equipment failure or data loss.
However, electronic equipment and storage devices can occasionally fail.
If footage is lost or damaged because of a failure that could not reasonably have been prevented despite appropriate professional care, we will work with the client to reach a reasonable solution considering the circumstances.
Nothing within these terms excludes liability where it would be unlawful to do so.
31. Quality of Services
Elite Filming will provide its services with reasonable care and skill.
Nothing within these Terms of Service removes or limits any statutory rights that a consumer has under applicable UK law.
32. Liability
Elite Filming will not be responsible for losses that could not reasonably have been anticipated when the contract was entered into.
For business clients, unless the law requires otherwise, our total liability relating to a project will normally be limited to the total amount paid or payable to Elite Filming for that project.
This limitation does not apply to liability that cannot legally be excluded or restricted, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nothing within these terms is intended to restrict a consumer’s statutory rights.
33. Complaints
If you are unhappy with any aspect of our service, please contact Elite Filming as soon as possible.
Please explain the issue and give us a reasonable opportunity to investigate and, where appropriate, correct it.

34. Privacy
Personal information is handled in accordance with our Privacy Policy.
Clients should read our Privacy Policy for information regarding how we collect, use, store and protect personal information and recorded footage.
35. Changes to the Agreed Project
If the client changes the scope of a project after booking, including changes to filming hours, locations, deliverables, crew requirements or editing requirements, Elite Filming may revise the quotation.
Any significant additional costs will be communicated before the additional work is undertaken wherever reasonably possible.
36. Entire Agreement
The agreed quotation, booking confirmation, any written project specification and these Terms of Service together form the agreement between Elite Filming and the client.
Where a specific written quotation expressly conflicts with these general terms, the specifically agreed written term will normally take priority for that project.
37. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue to apply.
38. No Waiver
If Elite Filming does not immediately enforce a particular term, this does not mean that we have permanently given up the right to enforce that term.
39. Governing Law
These Terms of Service are governed by the laws of England and Wales.
If you are a consumer, you will continue to benefit from any mandatory legal protections that apply to you based on where you live.
